Personal Information You Provide

Device Information (App)

When you use our App, we may collect certain information about your device, including:

• Device type and model
• Operating system version
• Unique device identifiers (for push notifications)
• App version

Push Notification Tokens

If you opt-in to receive push notifications, we collect your device's push notification token. This token is used solely to send you notifications about special events, promotions, and updates from Whitewater Bar & Grill.

Cookies and Tracking Technologies

Our website uses cookies and similar technologies. When you first visit our site, you will be asked to choose your cookie preferences. We categorize cookies as follows:

• Essential cookies: Required for the website to function, including session management and your cookie preference settings. Cannot be disabled.
• Analytics cookies: Help us understand how visitors use our site through Vercel Analytics, Google Analytics 4, and custom event tracking. Google Analytics collects page views, device information, general location, and referral sources. All analytics data is anonymous and only collected with your consent.
• Marketing cookies: Currently not in use. If enabled in the future, they would deliver relevant promotions.

Analytics Data

With your consent, we collect anonymous analytics data through Vercel Analytics, Google Analytics 4, and our custom analytics backend to improve our website and App, including:

• Device type and browser information
• General geographic location (city/region level)
• Referral source (how you found our site)
• Form submission events (we track that a form was submitted, not the content)
• App performance metrics

Location Data

Our App uses your general location (Canon City, Colorado area) only for displaying relevant weather information on the patio weather widget. We do not track your precise location or store location history.

How You Opt In

Opt-in is verbal. Before sending any text, the AI agent asks: "I can shoot you a text right now to the number you're callin' from — sound good?" You must verbally agree ("yes," "sure," "sounds good," or equivalent) before any SMS is dispatched. The verbal consent event is timestamped and the call recording is retained for audit.

Texts are sent only to the originating caller-ID number. If you want a link texted to a different number, the AI agent will ask you to state and confirm that number on the same call before sending.

What We Send

Caller-requested transactional messages only:

• Online order link (Toast)
• Full menu link
• Directions to the restaurant
• Hours of operation
• Daily food specials page
• Toast Tables waitlist link
• Toast Tables reservation link
• Careers application page
• Google review link (only if the caller asks how to leave a review)
• Follow-up form-page links for catering, band booking, private event, and contact inquiries

We do not sell, share, or otherwise transfer SMS opt-in data, phone numbers, or consent records to third parties for marketing purposes.

Message Frequency & Rates

Message frequency varies and depends entirely on what the caller asks for during a call. A typical call generates zero to two messages. We do not send recurring messages, weekly promotions, or unsolicited follow-ups.

Standard message and data rates may apply, depending on your mobile carrier and plan. Carriers (T-Mobile, AT&T, Verizon, US Cellular, and others) are not liable for delayed or undelivered messages.

How to Opt Out

Reply STOP to any text from us at any time and you will be unsubscribed from all future messages. Reply HELP for help.

You may also email info@whitewaterbar.com or call (719) 269-1009 to be removed from text messaging.

SMS Sender Number

All SMS messages are sent from +1 (719) 431-8585 — the same number as our voice-AI phone line. Texts are delivered through our SMS provider, Telnyx (see Information Sharing & Third-Party Services below).

Cookie Preferences

When you first visit our website, a cookie consent banner allows you to choose which categories of cookies to accept. You can change your preferences at any time by clearing your browser's local storage for our site.

Push Notifications

You can opt-out of push notifications at any time by:

• Going to your device's Settings > Notifications > Whitewater Bar
• Disabling notifications within the App settings

Newsletter

You can unsubscribe from our newsletter at any time using the unsubscribe link in any newsletter email. You may also contact us directly to be removed from the mailing list.

Data Deletion

You may request deletion of your data by contacting us at the email address below. Upon request, we will delete:

• Your device push notification token
• Your newsletter subscription records
• Contact form submissions associated with your email
• Any associated analytics data

For rewards program data managed through Toast, please contact Toast directly or contact us and we will facilitate the request.

We will process deletion requests within 45 days.
